By accessing or using ActiveAgentData.com ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
ActiveAgentData provides contact data for real estate agents in the United States. Data is delivered in CSV format via email after purchase. All sales are automated and self-service.
3. Data Accuracy
While we make reasonable efforts to ensure data accuracy and freshness, ActiveAgentData provides all data on an "as is" and "as available" basis. We do not guarantee the accuracy, completeness, or reliability of any data provided. Contact information may change without notice, and some records may contain outdated or incorrect information.
You acknowledge that real estate agent data is inherently dynamic and that some contacts may be inactive, have changed roles, or have updated their contact information since our last update.
4. Permitted Use
Data purchased through ActiveAgentData may be used for lawful B2B marketing and business purposes, including email outreach, direct mail, phone calls, and CRM import. You are solely responsible for ensuring your use of the data complies with all applicable laws and regulations, including but not limited to:
- CAN-SPAM Act
- Telephone Consumer Protection Act (TCPA)
- State-specific privacy and marketing laws
- Any applicable Do Not Call regulations
5. Prohibited Use
You may not resell, redistribute, sublicense, or publicly share the data purchased from ActiveAgentData. You may not use the data for any unlawful, harassing, or fraudulent purpose.
6. Payments and Refunds
All payments are processed securely through Stripe. All sales are final. Due to the nature of digital data products, refunds are generally not provided once data has been delivered. If you receive significantly fewer valid contacts than your selected tier, contact us and we will review your case on an individual basis.
7. Limitation of Liability
To the maximum extent permitted by law, ActiveAgentData, its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service or the data provided, including but not limited to lost profits, lost revenue, business interruption, or loss of data.
Our total liability for any claim arising from the Service shall not exceed the amount you paid for the specific data purchase giving rise to the claim.
8. Disclaimer of Warranties
The Service and all data are provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We make no warranty that the Service will be uninterrupted, secure, or error-free.
9. Indemnification
You agree to indemnify and hold harmless ActiveAgentData and its owners from any claims, damages, losses, or expenses arising from your use of the data or violation of these Terms.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
